These official rules (“Official Rules”) apply to the Install Survey promotion (“Promotion”) conducted by Acorn Graphics LLC and/or its related entities (“Sponsor”). This Promotion will be announced via an email, website pop-up window, and/or the installation application card included with all decal orders (“Promotion Announcement”). A Promotion Announcement will be delivered in the method determined by the Sponsor to select, intended recipients and will include the applicable methods of entry, entry deadline, drawing date, prize(s)/value(s), and a link to these Official Rules. All information contained in the Promotion Announcement is incorporated herein by reference.

 

Eligibility

Open to legal residents of the fifty (50) United States and the District of Columbia, who are at least eighteen (18) years of age and the direct and intended recipient of the Promotion Announcement. Void outside the area stated and where prohibited by law. Employees and other workers, including temporary employees, freelancers, and independent contractors (and their immediate families (parent, child, spouse, or sibling and their respective spouses, regardless of where they reside, and those living in their same households, whether or not related) of Sponsor, its parent, affiliates, subsidiaries, sponsors, promotional partners, and advertising and promotional agencies are not eligible to enter to win. By participating, participants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Promotion. This Promotion is subject to all applicable federal, state, and local laws.

 

Promotion Period

The Sweepstakes begin on June 1, 2022, at 12:00 a.m. MST and end on December 31, 2022, at 11:59 p.m. MST. All entries must be received by December 31, 2022, at 11:59 p.m. MST.

 

Prize(s)

Three (3) winners will be selected by random drawing on January 2, 2023. Each winner will receive one (1) Amazon Gift Card with a retail value of one hundred dollars and zero cents ($100.00). The gift cards will be issued digitally by email — physical gift cards will not be provided. The odds of winning depend on the number of eligible entries received. Any and all prize-related expenses, including without limitation any and all federal, state, and local taxes, shall be the sole responsibility of the winner(s). 

 

How to Enter

There are two (2) ways to enter this Promotion: (1) Survey Completion: prior to the entry deadline for this Promotion, click through the survey link in the applicable Promotion Announcement, answer the survey question(s), and complete and submit the Promotion entry form in its entirety to be entered for a chance to win, and (2) By Mail: To enter the Promotion without completing the survey, hand-print your full name, date of birth, email address, street address (including city, state and zip code), day and evening telephone numbers and the name of this Promotion on one side of a 3”x5” index card and mail it in an envelope with proper postage affixed to: Survey Promotion Entry, Acorn Graphics, 371 West Industrial Drive, Pleasant Grove, Utah 84062. Mail-in entries must be postmarked by the entry deadline specified in the applicable Promotion Announcement and received no later than seven (7) days thereafter. Limit one (1) entry per person/email address/household per Promotion, regardless of method of entry. Multiple entries received from any person, email address, or household will be void. Entries generated by script, macro, or other automated or mechanical means or by any means which subvert the entry process will be void. All entries become the property of the Sponsor and will not be acknowledged or returned. 

 

Drawing(s)/Winner Selection

Potential winner(s) will be selected in a random drawing from all eligible entries received, and notified by email within seven (7) business days following the conclusion of this Promotion. Odds of winning depend on the number of eligible entries received for this Promotion. 

 

Potential winner(s) may be required to execute and return an affidavit of eligibility, a liability release, and where lawful, a publicity release within the time period specified by the Sponsor. As applicable, if such documents are not returned within the specified time period, the prize notification is returned as undeliverable, or a potential winner is not in compliance with these Official Rules, then such potential winner will forfeit their prize and, at Sponsor's discretion, an alternate winner may be selected, time permitting. If a potential winner is at least eighteen (18) years of age but still considered a minor in their jurisdiction of residence, such potential winner’s prize may be awarded in the name of their parent or legal guardian, who will be responsible for fulfilling all requirements imposed on winners as set forth herein. 

 

In the event of a dispute about the identity of the winner(s), the winning entry will be determined based on the authorized account holder of the email address submitted at the time of entry. An authorized account holder is the natural person who is assigned the email address by the Internet Service Provider (ISP), online service provider, or other organization responsible for assigning email addresses. 

 

The Sponsor will attempt to notify the winner(s) using the email address provided within seven (7) business days following the selection of the winner(s). To claim the prize, the winner(s) must send a reply email to the Sponsor’s notice of winning email from the email address used to enter within seven (7) business days of the date of the Sponsor’s notice of winning email. The Sponsor shall have no liability for winner(s) failure to receive notices due to spam, junk email, or other security settings or for the winner(s) provision of incorrect or otherwise non-functioning contact information. If the winner(s) cannot be contacted, is ineligible, fails to claim the prize within seven (7) business days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate winner selected. Receipt by winner(s) of prize(s) offered in this promotion is conditioned upon compliance with any and all federal, state, and local laws and regulations. Any violation of these Official Rules by winner(s), as determined by the Sponsor in its sole discretion, will result in disqualification of the winner and forfeiture of any prize. 

 

Rights Granted to Sponsor by Participant

By entering this promotion, participants agree that the Sponsor, anyone acting on behalf of the Sponsor, and the Sponsor’s licensees, successors, and assigns, shall have the right, where permitted by law, to use in any media now known or hereafter developed, in perpetuity and throughout the world for purposes of services, trade, advertising, marketing, or promotion, without any further compensation, notice, review, or consent. 

 

Release and Waiver

As a condition to entering this promotion, participants (i) agree to release and hold harmless the Sponsor and its subsidiaries, affiliates, advertising and promotional agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, loss, injuries, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such participants’ participation in the promotion and/or their acceptance, possession, use or misuse of any prize or any portion thereof, and (ii) waive all rights to punitive, indirect, incidental, consequential damages, attorney’s fees, or any other damages other than participant’s actual out-of-pocket expenses incurred to participate (i.e. costs associated with entering this promotion). 

 

General Rules

All applicable federal, state, and local laws apply. In the event of a discrepancy or inconsistency between disclosures or other statements contained in any promotion-related materials or notifications and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control. 

 

The Sponsor reserves the right, in its sole discretion, to disqualify any participant or void any entry resulting from (i) tampering or attempted tampering with the entry process through the use of multiple IP addresses, email addresses, identities, or devices, (ii) the use of bots, macros, scripts, or other technical means of entering, or (iii) any other circumvention or attempted circumvention of these Official Rules. 

 

The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the promotion should any virus, bug, non-authorized human intervention, fraud, technical problem, or other cause beyond the Sponsor’s control corrupt or affect the administration, security, fairness, or proper conduct of the promotion. In such a case, the Sponsor may select the winner(s) from all eligible entries received prior to and/or after (if appropriate) the action taken by the Sponsor. 

 

The Sponsor is not responsible for: (i) electronic or digital transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation of transmission, communication failures (including but not limited to failures or mamlfunctions of any computer, cable, network, hardware, software, other mechanical equipment, phone lines, telephone systems or other communications systems), destruction of or unauthorized access to, or alteration of, entries; (iii) failed or unavailable hardware, network, internet, software or telephone transmissions; (iv) damage to participants’ or any person’s computer; (v) unauthorized human intervention in any part of the entry process or the promotion; (vi) electronic or human error in the administration of the promotion or the processing of entries; (vii) causes beyond the Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity, or proper conduct of this promotion; (viii) incorrect or inaccurate entry information whether caused by participants or by any of the equipment or programming associated with or utilized in the promotion; (ix) any typographical or other error in the printing or advertising related to the promotion, in the administration or execution of the promotion, or in the announcement notification of prize winner(s); or (x) cheating or fraud by any participant. 

 

Any attempt by any participant to deliberately damage or undermine the legitimate operation of the promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to disqualify, prosecute, and seek damages from such participant to the fullest extent permitted by law. 

 

As a condition of participating in this Promotion, participants agree to be unconditionally bound by these Official Rules and represent and warrant that they meet the eligibility requirements. In addition, participants agree to accept the decisions of the Sponsor as final and binding as it relates to participation in the promotion. 

 

Disputes, Venue, and Governing Law

As a condition of participating in this Promotion, participants agree that: (i) any and all disputes, claims that cannot be resolved between the parties, and causes of action arising out of, or in connection with, this Promotion or any prize awarded (if applicable) shall be resolved individually, without resort to any form of class action, and exclusively by a court having jurisdiction in Pleasant Grove, Utah; (ii) any and all claims, judgements, and awards shall be limited to actual out-of-pocket costs incurred in connection with entering this Promotion but in no event attorney’s fees; and (iii) to the extent permitted by applicable law, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental and/or consequential damages and/or any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of any participant or the Sponsor in connection with the Promotion shall be governed by and construed in accordance with the internal laws of the State of Utah without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any promotion-related materials or notifications and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.

 

Privacy Policy

Any personal information collected through this Promotion is subject to the Sponsor’s Privacy Policy. By entering this Promotion, participants agree to the use of personal information as described in the Privacy Policy.
